'New village hall will knock your socks off'

Reply to letter by Mr Arthur Whiteway, printed in the 15.02.2008 edition.

Point 1 We the trustees have paid the council for any time or services of the parish clerk

at the rate of 13.00 per hour

Point 2 Any letters read out by the clerk are not from him but from the secretary of the charity.

Point 3 & 4 The parish council have been asked to pay invoices out of the 500,000 and the 106 monies only. The money has always remained with the parish council until Invoices are produced for payment.

Point 5,6,7, & 8 are all parish related, and we of the charity can not answer these questions.

It is the duty of the borough council to provide facilities for the library not the charity of Kiveton Park and Wales village hall.

Hope you have noticed Mr Whiteway that the new roof on the library and the refit are now complete.

Parish meetings can not be held in a building that is licensed to sell alcohol. We of the charity would have been only too pleased for the parish council to have a room in the new building. The clerk has been allowed to have a small side office as this is not licensed.

Also disabled people who have had no access to the clerk for the past five years will now be able to visit the clerks office. (For legal confirmation of this ruling please contact the parish clerk)

For the LAST TIME Mr Whiteway the parish CAN NOT build on land which they do NOT OWN. The people of Kiveton Park and Wales own the building under the Kiveton Park and Wales Village Hall Charity (Charity Reg No: 1122196). We the trustees only manage this charity for and on behalf of the people.

Yet again you mention private companies. The charity is NOT AND NEVER WILL BE A PRIVATE COMPANY. It is a company limited by guarantee to protect the trustees, it is now called a Charity incorporated Organisation as there are NO PAID DIRECTORS, PAID TRUSTEES OR SHAREHOLDERS.

All profits go straight into the charities bank account for the upkeep and running of the hall.

The Community Development Trust (known as the CDT) is a charity and a company limited by guarantee, and you Mr Whiteway are a director of the CDT.

So how come you say we are a private company but you in your role as a director of the CDT are not a private company. Yet our charity is run in exactly the same way as the CDT as a Charity Incorporated Organisation.

Do the directors of the CDT have wages or dividend payments each year? Answer No. Neither do we.

Or did you not know you are a director of a Charity Inc Organisation? Or are you just confused?

As a charity which belongs to the people of the village why should the charity be charged for the mention of the new hall in the parish news.

Surely this is parish news. It is the greatest thing to happen in our village for many many years.

The response to the new hall has been tremendous. The new hall will enhance and help to change people's lives.

Finally Mr Whiteway we must commend the new management of the CDT for their good work, although I must say you have had it easy as you have not suffered the abuse and public discrediting that we of the charity have had to suffer over four years of voluntary hard work.

It is easy to sit back and critisie, without lifting a finger of help.

How can the parish council be responsible for "Post Contractual Terms" as the parish council did not and never has signed for the building of the new village hall.

The charity of Kiveton Park and Wales Village Hall owns the building for and on behalf of the people of our villages. As for accumulating information, it takes years, yes years, to accumulate information as regards to the parish council the CDT and the charity.

Three to six months on each does not even scratch the surface. Charity law like council law is very complicated and takes a lot more that a handful of meetings to accumulate and understand these laws.

Yet again it is easier to walk away sulking and then get on your high horse, than to actually stay and work as a team. The parish council the CDT and the Charity of KP and Wales Village Hall are democracies not dictatorships.

I am only too happy to explain the meanings of:

1: Beneficial Owners: If the land of Wales Festival Hall was ever sold then the Charity of Wales Festival Hall would receive any and all monies relating to the sale of the land.

2: Custodian Trustees: A person or body of people (eg: Wales Parish Council) who watches over the land of Wales festival hall to ensure that the charity follows the articles and memoranda laid down by law. To also ensure that the land is only used for the people of our village and that the family ethos (values) are always meet. As custodian Trustees the Parish Council do not own the land but are the watchdogs.

3. Company Limited by Guarantee: Usually a company limited by guarantee would be a private company. BUT WHEN ATTACHED TO A CHARITY it becomes a Charity Incorporated Organisation (CIO). Hence the Charity of Kiveton Park and Wales Village Hall which does not have any paid directors, trustees or shareholders is not a private company.

A CIO was formed to protect the trustees of our charity. Trustees of charities are liable for any debts incurred by the charity (eg: their homes could be repossessed) all charities are nowadays are legally advised to become a company limited by guarantee to protect the assets of the trustees.

Further explanation: The land in question belongs to the charity of Wales Festival Hall. The new village hall is owned by Kiveton Park and Wales Village Hall Charity. The charity of KP and Wales village hall leases the land from the charity of Wales Festival Hall. Thus ensuring the land always will belong to the people of our community.

We would like to thank the Old Kivetonian and The Wales Villager for their support. Also the many people who have stopped to tell us that the hall is the best thing to happen in Kiveton Park for a long time.
